Terms of Service

1. Service Description

Xamio (xamio.com) is an adaptive exam preparation platform designed for the AMIRNET English proficiency exam. The Service provides practice drills, full-length mock exams, vocabulary review, and performance analytics.

2. Account Registration and Responsibilities

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 18 years old or have parental consent to use the Service.

3. Free Tier

The Free tier provides limited access to the Service, including 3 drills per question type, 1 full mock exam, vocabulary browser with flashcards, and basic performance stats. We reserve the right to modify the Free tier offering at any time.

4. Premium Subscription

4.1 Billing

Premium subscriptions are billed monthly in advance at the then-current rate. Payment processing is handled securely by Polar.sh. By subscribing, you authorize Polar.sh to charge your chosen payment method on a recurring basis.

4.2 Cancellation

You may cancel your Premium subscription at any time. Upon cancellation, you retain access to Premium features until the end of your current billing period. No refunds are provided for partial billing periods.

4.3 Price Changes

We may change subscription prices with 30 days' notice. Continued use after the price change takes effect constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent any technical limitations
• Share your account credentials or allow others to use your account
• Scrape, copy, or reproduce content from the Service without authorization
• Use automated tools (bots, scripts) to interact with the Service
• Misuse the AI features for any prohibited purpose

6. Intellectual Property

All content provided through the Service, including question banks, explanations, vocabulary data, and software, is owned by or licensed to Xamio. You may not reproduce, distribute, modify, or create derivative works without our express written permission. Your exam answers and usage data remain your property; we retain a license to use anonymized data for Service improvement.

7. Limitation of Liability

To the maximum extent permitted by law, Xamio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

8. Governing Law

These Terms are governed by the laws of the State of Israel. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tel Aviv, Israel.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any lawful reason. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the dashboard settings.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes your acceptance of the modified Terms.
